Return Policy on oxidised wines?

Hello guys,
I opened up a 1992 Meshach for tea tonight. I am no expert, but it would appear to be oxidised. Opened around 3 hours ago & decanted it, but nose still remains dull and flat, and its hot on the palate.
I know the situation of corked wines is (reasonably) clear, but what about situations like this? Do they replace oxidised wines? (I was at Magill Estate some years ago, and they ditched several oxidised bottles while we watched them decanting...)
Anyhow, we have gone for the reserve bottle - a 1996 Kalimna- looking good, but still disappointed.... thanks
